The Appellate Division of State Supreme Court, Third Department, has just rendered a decision telling the Governor Cuomo and his Health Department that they are “temporarily enjoined and prevented” from enforcing the ban on flavored e-cigarettes that was scheduled to go into effect tomorrow.
This means that for now, stores in New York may continue selling flavored e-cigarettes.
We do not know how long this temporary restraining order will remain in place. The Appellate Division indicated the next legal step is a determination by the State Supreme Court in Albany County on the Vaping Technology Association’s motion for a preliminary injunction against the ban.
